1. Agreeing to these Terms

FindMortgageProtection.com (the "Site") is run by Clear Path Creative, LLC ("Clear Path Creative," "we," "us" or "our"). These Terms of Use ("Terms") are the rules for using the Site and the services on it. By using the Site or sending a request, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

Section 12 says that most disputes will be settled by individual arbitration, not in court, and that you give up the right to a class action or a jury trial. Please read it.

2. What the Site does

The Site is a referral service. You answer a few questions and ask for a quote, and we pass your request to licensed insurance agencies and agents on our Partner list so they can contact you about life insurance.

We are not an insurance company. We don't sell, quote, underwrite or recommend life insurance policies through the Site. Quotes, advice, applications and policies come from the licensed agents and the insurance companies they work with, under their own terms.

3. What the Site doesn't promise

  • Sending a request does not put insurance in force, and it doesn't commit you to buy anything.
  • We don't promise that an agent will reach you, that you'll get a particular price, or that you'll qualify for any policy. Whether you qualify, and what it costs, depends on the insurance company, the policy and your situation.
  • Information on the Site is general and for education only. It isn't financial, legal, tax or insurance advice.
  • We don't endorse any particular agent, agency, insurance company or policy.

4. Who can use the Site

To use the Site you must be at least 18 years old and live in the United States. You agree to give true and complete information, to use your own name, and to give only a phone number that belongs to you or that you're allowed to use.

5. Calls and texts

If you check the consent box and send a request, you agree that FindMortgageProtection.com and the companies on its Partner list may call and text you about life insurance at the number you entered, including with an autodialer or a prerecorded, artificial or AI voice, as stated next to the box. Consent is not a condition of any purchase. Message and data rates may apply.

You can opt out at any time: reply STOP to a text, ask a caller to put you on their do-not-call list, or email us (section 16). Opting out with us doesn't opt you out with a partner who already has your information.

6. Using the Site properly

You agree not to:

  • use the Site for anything illegal;
  • pretend to be someone else or send someone else's information without permission;
  • send false or misleading information;
  • try to break into, disrupt or overload the Site or the systems behind it;
  • copy, scrape or harvest content or data from the Site with automated tools;
  • upload viruses or other harmful code;
  • copy, resell or use the Site for a business purpose without our written permission.

We may block or stop your access to the Site if we reasonably believe you've broken these Terms.

7. Our content

The Site and its content, including the text, design, graphics and the FindMortgageProtection.com name and logo, belong to Clear Path Creative or its licensors and are protected by law. You may view the Site for your own personal use. You may not copy, change, share or reuse it without our written permission. If you send us ideas or feedback, we may use them without paying you.

8. Partners and other websites

Agents, agencies and insurance companies that contact you are separate businesses. Each one is responsible for its own products, advice, prices and conduct, and we aren't responsible for them. The Site may also link to other websites. We don't control them and aren't responsible for them. Your dealings with them are between you and them.

9. Disclaimer

The Site is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Site will always be available, secure and without errors, or that its information is always complete and current.

10. Limits on our liability

To the fullest extent the law allows, Clear Path Creative and its owners, employees, contractors and service providers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, arising from your use of the Site or from anything a partner or insurance company does. If we are found liable to you, our total liability for all claims won't be more than $100. Some states don't allow some of these limits, so they may not all apply to you.

11. Your responsibility

You agree to defend and repay Clear Path Creative and its owners, employees and contractors for any claims, losses and costs (including reasonable attorneys' fees) that come from your misuse of the Site, your breaking these Terms or the law, or information you send that isn't true or isn't yours to send.

12. Settling disputes: arbitration and class action waiver

Try to work it out first. Before starting arbitration, you and Clear Path Creative agree to try to settle any dispute informally for 30 days after written notice is sent to the other side. Send notice to us at the address in section 16.

Arbitration. Except as stated below, any dispute arising from or relating to the Site, these Terms, or any call or text described in them will be settled by binding arbitration on an individual basis, run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and governed by the Federal Arbitration Act. A single arbitrator will decide the dispute and may hold the proceedings by phone, video or written submissions. Any in-person hearing will take place in Denver, Colorado. AAA's Consumer Rules decide who pays the fees: you pay any consumer filing fee those rules require, and we pay the rest of AAA's and the arbitrator's fees as those rules require. Each side pays its own lawyers unless the arbitrator awards otherwise under the law. The arbitrator can award the same individual relief a court could.

Small claims. Either side may instead bring a claim in small claims court if it qualifies.

No class actions or jury trials. Disputes may be brought only on an individual basis, not as a plaintiff or class member in any class, group or representative action. The arbitrator can't combine claims or run a class or representative proceeding. If a dispute goes to court instead of arbitration, you and we both give up the right to a jury trial.

Court orders. Either side may ask a court for a temporary order to protect intellectual property or stop unauthorized access to data while a dispute is resolved.

Time limit. Any claim must be brought within one year after it arises, unless the law requires a longer period.

If part of this section can't be enforced, the rest still applies. This section continues even after you stop using the Site.

13. Governing law

Colorado law governs these Terms, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration section. For anything that goes to court, you and we agree to the state and federal courts in Denver, Colorado.

14. Changes

We may change the Site or these Terms at any time. When we change the Terms, we'll update the "Last updated" date at the top. If you keep using the Site after a change, the updated Terms apply. Changes don't apply to a dispute that was already in progress.

15. General

These Terms and our Privacy Policy are the whole agreement between you and us about the Site. If a court finds any part unenforceable, the rest stays in effect. If we don't enforce a part of these Terms, we haven't given up the right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours. We aren't responsible for delays or failures caused by events beyond our reasonable control.
